Governing Law and Dispute Resolution

Any dispute concerning this website or its use shall be governed by the laws of the State of New York, without regard to conflict-of-law principles. As a condition precedent to filing any lawsuit or proceeding, you must serve a written Notice of Claim on NERKO’s registered agent within ninety days of becoming aware of the facts giving rise to the claim. The Notice must state your name and contact information, describe the dispute and underlying facts, identify the legal basis of the claim, include supporting documents, and specify the relief sought. After service, the parties may engage in negotiations for sixty days before any proceeding may be filed. Any proceeding shall be brought exclusively in a court located in Albany, New York and DECIDED WITHOUT A JURY. Failure to comply with these requirements bars the claim.
